Abstract:

This research came to trace the factors of the emergence of the two schools of hadith and opinion, which constitute the major trends in Islamic jurisprudence, or what is called the school of Iraqis as the people of opinion, and the school of al-Hijazis as the people of hadith.

In view of the importance of the two schools in formulating the jurisprudential principles of the schools of thought and the jurists, this research came to explain their reasons in their historical contexts, and their impact on the applied aspects of the jurisprudence of the jurists.

The research answers the following questions:

1. What is meant by the school of hadith and the school of opinion?

2. What are the factors that led to the emergence of the school of hadith?

3. What are the factors that led to the emergence of the school of opinion?

4. What are the most prominent applied jurisprudence issues that show the difference in ijtihad between the two schools of hadith and opinion?

Research Methodology: The descriptive approach will be followed to clarify the concept of the school of hadith and the school of opinion, then it will be followed by the deductive approach to determine the factors of the emergence of the two schools, then we follow the practical and applied aspect that is evidenced by the jurisprudence of the jurists.

The introductory topic: what is meant by the school of hadith and the school of opinion.

The first topic: the factors of the emergence of the modern school.

The second topic: the factors of the emergence of the school of opinion. The third topic: applied jurisprudential issues.
