المستخلص [English] Abstract: |
Due to the rapid development in the Saudi laws, and the increasing interest in applying formal standards in courts, this research is to clarify one of the most important formal defenses which is the statute of limitations which means the laws passed to set the maximum time after an event within which legal proceedings may be initiated. It is an important component of the stability of legal centers. The research showed the types of rights and their relationship to the statute of limitations and its impact on them. it also explained the meaning of the statute of limitations and its types in the Saudi law. After that, there was an applied study of this principle in the Negotiable Instruments law, considering the limitation periods of the check, the bill of exchange and the promissory note. Another applied study of this principle in some procedural laws including: criminal procedures, The law if Litigation before the Board of Grievances, and Enforcement Law. Finally, the research briefly discusses the criticism of the principle of limitation. At the end this research discussed briefly some of the criticism of this principle. |
